## Question

Define Tender. What are the essential informations to be given in the Tender Notice? (Tender and elements of tender.)

## Short answer

A tender is a formal written offer to supply goods, works, or services at a quoted price. The notice must state the procuring entity, scope, procurement method, eligibility, bid document details, bid security, submission and opening dates, completion period, and the right to reject bids.

## Answer

A **tender** (bid) is a formal written offer by a bidder to supply goods, construct works or provide services at a quoted price and on stated conditions, in response to an invitation from the employer. Once accepted, it forms the basis of the contract.

#### Essential information in a tender (bid) notice
Under the Public Procurement Act 2063 and Regulations 2064, the notice should state:
1. Name and address of the procuring entity (employer).
2. Name, nature, location and brief scope of the work, goods or services.
3. Procurement method and type (national or international, open, prequalification etc.).
4. Eligibility and qualification requirements (experience, turnover, equipment, firm registration, tax clearance, contractor's licence).
5. Where, when and at what cost the bidding documents can be bought or downloaded.
6. Bid security amount and validity.
7. Last date, time and place for bid submission, and date, time and place of bid opening.
8. Completion period and, where applicable, the source of funding.
9. Place and date of any pre-bid meeting or site visit.
10. Right of the entity to accept or reject any or all bids.

The notice is published in national newspapers and on the e-GP system for the minimum period set by the Act.
